Citizens of the Russian Federation who live in residential premises owned by the state or municipality have the right to free privatization of housing. At the same time, the procedure for free transfer of ownership of such housing is regulated by Federal Law No. 1541-1 of July 4, 1991 "On the privatization of the housing stock".

History of privatization in the Russian Federation

In its original form, the law on privatization, adopted in 1991, assumed that the right of citizens in question would be valid until January 1, 2007. Then it seemed that the time period allotted for the implementation of this right would be quite enough so that all citizens wishing to register the ownership of the dwelling in which they live could have time to go through the necessary bureaucratic procedures.

However, closer to the onset of this deadline, it turned out that not everyone who wanted to do so managed to exercise their legal right. As a result, at the end of 2006, huge queues began to form in the bodies of state registration of rights to real estate, and legislators decided to postpone the expiration of this right. After that, this situation was repeated several times.

Duration of the Privatization Right

Actually, Federal Law No. 1541-1 of July 4, 1991 "On the privatization of the housing stock" does not contain any indication that the duration of the right to privatization has a specific time frame. The expiration of such a right is usually established by additional regulations.

So, at the moment, the main document governing the timing of privatization is Federal Law No. 189-FZ of December 29, 2004 "On the Enactment of the Housing Code of the Russian Federation." The previous current version of this regulatory legal act provided for the end of the free privatization of housing on March 1, 2013.

However, shortly before the entry into force of this edition, legislators revised the provisions of this law again, postponing the date of completion of privatization to March 1, 2015. Thus, as of today, Russian legislation provides that those citizens who do not privatize the dwelling in which they live, before this date, will be deprived of such a right in the future, so they should hurry up to exercise their legal right. However, the previous scenario of the development of events does not exclude the possibility of another postponement of the completion date of privatization.
