Instructions

Step 1

“Is it possible to patent your literary work?” Many authors ask. And the experts answer: "No!" After all, a patent is given only for a practical invention. You can only design your book as your property through copyright.

Step 2

Remember that copyright arises automatically from the moment a work is created. In order for the right of exclusive possession of an object to appear, there is no need to specially register the book or draw it up in any other way. To indicate that this printed publication is protected from illegal use, there is a special sign consisting of three elements. This is directly the Latin letter C (from English Copyright), placed in a circle, the name or title of the copyright holder, as well as the year of the first publication of the work.

Step 3

In the event that there is no special symbol indicating your authorship, you can try to prove your ownership of the work in another way. In the absence of clear evidence, the person who is listed as the author on the original manuscript or on a copy of the work that was published for the first time will be considered the author of the book.

Step 4

When the author did not leave his name on the cover or worked under a pseudonym (but only under the one for which it is impossible to recognize the identity of the author), the publisher will have the copyright for the work. From this moment on, his responsibilities will include everything related to the protection of these rights and ensuring their implementation.

Step 5

If you want to transfer your copyright to another person, you can do it in several ways. The first is in order of inheritance. This provision is regulated by Article 1283 of the Civil Code of the Russian Federation. The second is the transfer of rights with the conclusion of an alienation agreement. According to article 1285 of the Civil Code of the Russian Federation, which regulates this provision, when transferring copyright in this way, you must draw up a special license agreement, where all the nuances will be spelled out.
